1. Purpose

This Refund Policy explains the main refund principles that apply to students of Mosman College. It is a public summary and must be read together with the student's current Letter of Offer, Written Agreement, fee schedule, and any approved payment arrangement.

2. General Principles

Mosman College provides students with clear pre-enrolment information about fees, charges, and refunds. Refund requests are assessed case by case against:

  • the student's written agreement
  • the applicable fee schedule
  • the timing and reason for withdrawal, cancellation, visa outcome, or provider default
  • any applicable legal obligations, including consumer protection requirements and tuition protection requirements where relevant

This public policy does not replace the student's written agreement.

3. Circumstances Where a Refund May Be Available

Depending on the student's circumstances and written agreement, a refund may be considered where:

  • a student withdraws before course commencement
  • a student withdraws after commencement due to approved exceptional, compassionate, or compelling circumstances
  • a student visa application is refused, where applicable and supported by the required evidence
  • Mosman College is unable to commence or deliver the agreed course or services
  • another circumstance exists under the student's written agreement or applicable law

The amount refundable, if any, will depend on the written agreement, the timing of the request, the services already provided, and any non-refundable fees or committed costs.

4. Non-Refundable and Additional Costs

Some fees and charges may be non-refundable. Depending on the student's agreement and fee schedule, this may include items such as:

  • enrolment or administration fees
  • materials or resources already issued or committed
  • personal protective equipment or other compulsory items purchased for the student
  • replacement document fees, resubmission fees, RPL or course credit fees, or similar additional charges where applicable

Students should review their written agreement and fee schedule carefully before accepting an offer.

5. Provider Default and Services Not Provided

If Mosman College is unable to provide the agreed services, students will be advised in writing as soon as practicable. Where applicable, Mosman College will:

  • arrange a suitable alternative at no extra cost to the student, or
  • provide a refund for services not delivered, calculated in accordance with the student's written agreement and applicable legal requirements

Where tuition protection requirements apply, those arrangements will be managed in accordance with the relevant legal framework.

6. How to Apply for a Refund

Refund requests must be made in writing and submitted to Mosman College at `office@mosman.group`.

Students should provide:

  • their full name and student number if issued
  • the course name
  • the reason for the request
  • the date of the request
  • any supporting evidence relevant to the request, such as visa refusal evidence or documents supporting exceptional circumstances

Mosman College will provide the current refund request form and any instructions required to support assessment of the request.

7. Assessment and Outcome

Refund applications are assessed against the student's written agreement and current approved refund settings. Where a refund decision is made, Mosman College will provide the outcome in writing.

Before any approved refund is paid, the student will receive a written refund statement in plain English that explains:

  • the reason the refund decision was made
  • how the refund amount was calculated
  • the expected processing timeframe
  • the student's right to seek further action or make a complaint

8. Refund Processing Timeframe

Where a refund is approved, Mosman College will process the refund within the timeframe required under the student's written agreement and any applicable legal requirements. Where more than one timeframe applies, the shorter applicable timeframe will apply.

Processing time may be affected if required supporting evidence has not been provided.

9. Complaints About Refund Decisions

If a student is dissatisfied with a refund decision, they may use Mosman College's Complaints and Appeals process.

Access to the Complaints and Appeals process does not remove the student's right to take action under Australian consumer protection laws where those laws apply.

10. Records

Mosman College keeps refund applications, supporting evidence, outcomes, and related correspondence in accordance with its records management obligations.
